Jurisdiction and Venue

Jurisdiction and Venue shall lie in the Superior Court of Fresno, County, California in all disputes that may arise between you and TRAVEL EXPRESS or its affiliates.

Disputes

Any dispute relating in any way to your visit to ETRAVELEXPRESS.COM or to products you purchase through ETRAVELEXPRESS.COM shall be submitted to confidential arbitration in Fresno County, California, except that, to the extent you have in any manner violated or threatened to violate TRAVEL EXPRESS intellectual property rights, TRAVEL EXPRESS may seek injunctive or other appropriate relief in any state or federal court in the State of California, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

Cancellation Policy

Each cruise line and tour operator publishes a cancellation policy found in the back of the brochure. Please read it! In addition to cancellation penalties imposed by the cruise line or tour operator, TRAVEL EXPRESS may collect an administrative fee of $50 per person for cruises or tours of less than 7 days, and $100 per person for cruises or tours of 7 days or more.  This administrative fee applies regardless of reason for cancellation.
